Scope of Work (SOW)
The purpose of the USAID Rule of Law Program (ROLP) is to help establish an independent, accountable, well-functioning, and people-centered justice system in Georgia. One of the key activities is to establish at least three Rule of Law (ROL) Hubs in Georgia, in locations outside of Tbilisi, the first of which was launched in Batumi on April 1, 2022, the second in Kutaisi in December 2022, and opening the third hub in Akhaltsikhe is planned for the middle of 2023.
The purpose of the ROL Hub is to improve the delivery of justice in each targeted locality by developing linkages with and among the courts, Georgian Bar Association (GBA) branches, Legal Aid Service (LAS) offices, Public Defender (PDO) offices, law faculties, CSOs, representatives of law enforcement bodies, and the private sector within the locality, and to foment linkages between the representative offices in the locality and their counterparts in Tbilisi.
In the framework of the project Rule of Law Hubs will implement activities targeted to the local needs identified through meetings with the stakeholders. One of the topics interesting for lawyers and judges in Adjara region is construction law.
Proposed approach:
USAID Rule of Law Program seeks to hire a Georgian expert/team of experts that will support the Program to develop training module and materials on construction law and conduct the training for lawyers and judges in Adjara region.
The module shall minimum cover the law of Georgia on Construction Activities, the Code of Spatial Planning, Architectural and Construction Activities of Georgia, and other relevant normative acts that regulate main issues and principles of city, spatial, urban planning, architectural and construction activities on the territory of Georgia and municipal spatial planning in Adjara region; human rights, including the right to live in a healthy environment, right to property. Legal regulation of construction - the terms, conditions, and procedures for issuing building/construction permits, construction offenses, and the appropriate sanctions, grounds for suspension of acts issued in connection with city planning and building/construction permits. Practice the interpretation of construction law by the regional and appeal courts while resolving construction disputes and legal standards, regulating construction relations.
Timeline
The training is envisaged to be implemented in the period of May 1, 2023 – December 31, 2023
Reporting
The selected individuals will work closely with USAID Rule of Law Program Regional Rule of Law Advisor, Irina Lortkipanidze, Regional Hub Attorneys Irina Khakhutaishvili, and will report to Giorgi Chkheidze, Chief of Party and Neil Weinstein, Deputy Chief of Party.
Estimated Level of Effort:
The estimated level of effort is 10 working days, including 3 days for the development of the training module and materials; 6 days for the training of several groups of lawyers and judges in Adjara region, and 1 travel day.
