On November 8, 29, and 30, 2024, the USAID Rule of Law Program, through its Rule of Law Hubs organized a series of training sessions for lawyers from the Adjara, Imereti, and Samtskhe-Javakheti regions, attracting 80 participants across the three locations. The participants included members of the Georgian Bar Association (GBA) and the Legal Aid Service of Georgia (LAS).
The training, led by invited expert Levan Saneblidze, focused on the legal complexities of building and land registration. Key topics included land registration issues, such as the division and unification of immovable property, defining land purposes and registration, and procedures for registering rights to buildings. This covered construction activities and relevant registration processes. Specific areas of focus included: required documentation for registering building rights; procedures for addressing area discrepancies; integration of land areas into a unified system; extending property rights, including adjustments when specifying areas; emergence and registration of ownership rights for immovable property; registration of mortgage rights for buildings and land; and the rules for determining seizure and the debtor registry.
The training also featured a comparative analysis of local practices and the European Court of Human Rights (ECtHR) case law. This included an overview of key ECtHR decisions on property rights, with a focus on expropriation and deprivation of ownership rights. The concluding session explored procedural aspects of registering buildings under construction and the complexities of registering rights to agricultural and non-agricultural land.
