On December 9, 2024, the Group of Independent Lawyers and NGO Democracy Index – Georgia, with USAID Rule of Law Program and Georgian - Norwegian Rule of Law Association support, organized a presentation of the Georgian translation of Hans Petter Graver’s book “Valiant Judges, Iniquitous Law Thirteen Stories of Heroes of the Law.”
Forty participants, including lawyers, former judges, professors, and NGO representatives, participated in the event and engaged with Georgian and Norwegian experts in a discussion on the role of heroes in the judiciary. The remarks were delivered by Ekaterine Tsimakuridze, representing the Democracy Index – Georgia; Maia Bakradze and Irakli Kordzakhia from the Group of Independent Lawyers; Anders Lovlie board member of the Georgian - Norwegian Rule of Law Association and a professor at the University of Oslo; Anna Jobava, Civil Society Organizations Advisor at the USAID Rule of Law Program; and Nino Bakakuri, former Judge of the Supreme Court of Georgia.
In his presentation, Hans Petter Graver shared insights from his book, which emerged from his exploration of judicial systems in authoritarian regimes. He highlighted instances where judges displayed courage, moderation, wisdom, and justice, choosing not to follow the law blindly. The book also delves into the challenging question of whether judges have a moral obligation to uphold the rule of law, even when it conflicts with the written law. Graver’s work features thirteen powerful stories of judges who, in diverse contexts, stood firm against authority and public opinion in defense of justice and the rule of law.
Hans Petter Graver emphasized that in today’s challenging political climate, where reports indicate that the level of democracy has fallen to the levels seen in 1989, it is more important than ever to engage in discussions about legal heroes. He argued that such conversations can play a vital role in inspiring individuals, fostering a sense of shared values, and encouraging deep reflection.
The event concluded with a discussion, where participants explored a range of important topics. They delved into the current situation in Georgia, examining the challenges faced by the judiciary in the country. The conversation also addressed what can be considered acts of heroism by judges, particularly in oppressive systems, and the critical role judges play in upholding democracy in such environments. Participants talked about the importance of judicial decisions that should not only convey legal correctness but also instill a sense of fairness and reinforce the trust of the public.
