The USAID Rule of Law Program is assisting the Georgian Bar Association (GBA) in its mission to bolster legal research and reporting, foster transparency, knowledge dissemination, encourage open dialogue on legal matters, and facilitate international cooperation in legal development. These initiatives serve as fundamental pillars for the enhancement of Georgia's legal system and the promotion of the rule of law.
With the Program support, GBA has developed three comprehensive analytical documents that have been shared with a wider audience on October 11, 2023.
Over forty-five lawyers and civil society representatives attended a presentation event that opened with the welcome remarks from Davit Asatiani, the Chairman of GBA, and Rusudan Tabatadze, a Rule of Law Project Management Specialist from the Democracy, Rights, and Governance Office at USAID/Caucasus.
The research documents unveiled during the meeting cover critical aspects of the legal system, addressing the management of case backlogs in courts, challenges associated with judges' disciplinary proceedings, and the assessment of judge candidates for the first and second instances courts by GBA.
In the presentation that focused on the research and recommendations regarding the Management of Case Loads in Courts, the Co-Chairperson of the Justice and Judicial Reforms Committee at GBA, Sophio Sokhadze, alongside committee members David Kaloev-Dolbadze and Nino Andriashvili, shed light on the pressing issues tied to caseloads in the court system. The research paper puts forth recommendations designed to streamline and reduce case backlogs, ultimately enhancing the efficiency and effectiveness of the judicial process.
Lola Kurkumuli, Chairperson of the Justice and Judicial Reforms Committee of the GBA, presented the Recommendations on the Challenges in the Practice of Judges' Disciplinary Proceedings, which discuss challenges associated with the disciplinary proceedings of judges and provides recommendations for lawyers on effective enforcement of this mechanism.
The third paper presented at meeting was the Analytical Report on Assessment of Judicial Candidates for the first and second instance courts of Georgia, which was prepared by the GBA. This is a comprehensive document that outlines the mechanisms and principles for assessing the qualifications and suitability of individuals seeking judicial roles. Its objective is to establish transparent and merit-based criteria for the selection of judges, thereby contributing to the creation of a more competent and impartial judiciary.
Following the presentation of the research documents and recommendations, the next crucial phase entails their practical implementation. Effective public engagement and educational outreach will be instrumental in informing the legal community and the public about these proposed interventions. The continued collaboration with both international and local stakeholders, including USAID Rule of Law Program and the Georgian Bar Association, remains pivotal in sustaining the ongoing development of a more efficient, transparent, and competent legal system in Georgia.
